Public Offer Agreement
1. General Provisions
1.1. This offer is an official proposal by Individual Entrepreneur Syrytsia A. I. (hereinafter referred to as the "Seller") to enter into a distance sales contract (through an online store), posted on the Seller's website http://misstic.com.ua/ (hereinafter referred to as the "Website").
1.2. Acceptance of this offer is the Buyer's payment for the order in accordance with the terms of the Agreement and the prices indicated on the Website.
2. Concepts and Definitions
2.1. The terms within this offer have the following meanings:
- Product — lingerie sets, accessories, stockings.
- Online Store — a means for selling goods through an electronic transaction in accordance with the Law of Ukraine "On Electronic Commerce."
- Seller — an economic entity that sells goods posted on the website.
- Buyer — a natural person who has accepted the terms of this Agreement.
- Order — items selected by the Buyer for subsequent payment.
3. Subject of the Agreement
3.1. The Seller undertakes to transfer the Product to the Buyer's ownership, and the Buyer undertakes to pay for and accept it in accordance with the terms of this Agreement.
3.2. This Agreement regulates all stages of distance purchasing:
- independent product selection;
- order placement;
- payment;
- product delivery.
4. Order Placement Procedure
4.1. The order is formed by the Buyer independently through the Website.
4.2. The number of product units is unlimited.
4.3. In case of product unavailability, the Manager informs the Buyer.
4.4. The Buyer may:
- replace the product;
- cancel the corresponding item;
- completely cancel the order.
5. Payment Procedure
5.1. Payment is made online via LiqPay (Visa/MasterCard).
5.2. In case of non-payment, the order may be canceled.
6. Delivery Terms
6.1. Delivery is carried out through transport companies to their respective warehouses.
7. Rights and Obligations of the Parties
7.1. The Seller has the right to:
- terminate service if the terms of the Agreement are violated.
7.2. The Buyer is obliged to:
- pay for and receive the order in a timely manner.
7.3. The Buyer has the right to:
- place an order and enter into an agreement;
- demand that the Seller fulfill its obligations.
8. Liability of the Parties
8.1. Liability is regulated by current legislation.
8.2. The Seller is not responsible for:
- color differences due to screen settings;
- information entered by the Buyer;
- delivery disruptions due to independent reasons;
- illegal actions of the Buyer online;
- transfer of personal data to third parties.
8.3. The Buyer is responsible for all actions performed through their access.
8.4. In case of force majeure, the parties are released from obligations.
8.5. The parties resolve disputes through negotiations.
9. Other Terms
9.1. The Seller may make changes to the Agreement with prior publication on the website.
9.2. The online store is intended for online sales.
9.3. The Buyer is responsible for the accuracy of the data.
9.4. Payment signifies agreement with the terms of the offer.
9.5. The date of the electronic agreement is the date of acceptance.
9.6. Viewing goods and placing an order are free of charge.
9.7. The Buyer's personal data is confidential and used exclusively for order fulfillment.
10. Product Returns
10.1. Returns are not possible as the goods belong to a group that is not subject to return (Cabinet of Ministers of Ukraine Resolution No. 172 of March 19, 1994).
11. Term of the Agreement
11.1. The Agreement enters into force upon acceptance.
11.2. It may be terminated before delivery by mutual agreement of the parties with a refund.
11.3. Unilateral termination is possible in case of violation of the terms.
